1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the EchoGuard mobile application (“App”), developed and operated by Perceptix (“Company”, “we”, “us”, or “our”). By downloading, accessing, or using EchoGuard, you agree to be bound by these Terms. If you do not agree, you must not use the App.
2. Purpose of EchoGuard
EchoGuard is a facial recognition and alert application designed to compare scanned or uploaded facial images against publicly available data relating to wanted persons as reported by the South African Police Service (SAPS) and Interpol Red Notices.
EchoGuard does not determine criminal guilt, criminal history, or criminal records of any individual.
3. No Criminal Record Determination
EchoGuard cannot and does not confirm whether any person has a criminal record. The App solely provides information on whether a facial image matches profiles of individuals currently listed as wanted by SAPS or Interpol at the time of scanning.
4. Accuracy and Limitations
EchoGuard relies on image quality, lighting conditions, facial angles, database accuracy, and technical limitations. As a result:
Matches are probabilistic, not definitive False positives and false negatives may occur Results depend on third-party data availability and updates Perceptix makes no guarantee regarding the accuracy, completeness, or reliability of any result provided by the App.
5. Confidence Scores
EchoGuard displays a confidence level indicating the likelihood of a facial match. A higher confidence score does not constitute confirmation of identity.
Users are solely responsible for how they interpret and act upon confidence scores and match results.
6. Prohibition of Vigilantism
Perceptix strictly prohibits and does not condone vigilantism, harassment, confrontation, or any unlawful action against individuals identified by EchoGuard.
Users are strongly advised to:
Contact relevant law enforcement authorities, or Avoid individuals where a high-confidence match (90% or above) is displayed
7. No Guarantee of Safety
Use of EchoGuard does not guarantee personal safety. Users acknowledge that they use the App entirely at their own risk.
Perceptix shall not be held liable for any harm, injury, loss, or damages arising from the use or misuse of EchoGuard.
8. User Responsibilities
By using EchoGuard, you agree to:
Use the App lawfully and responsibly Comply with all applicable South African laws and regulations Not use the App for discrimination, harassment, stalking, or unlawful surveillance Obtain consent where required by law before scanning individuals
9. Limitation of Liability
To the fullest extent permitted by law, Perceptix shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from:
Use of EchoGuard Reliance on match results or confidence scores Errors, inaccuracies, or delays in third-party data
10. Data Sources
EchoGuard relies on external data sources, including SAPS and Interpol Red Notice information. Perceptix does not control the accuracy, completeness, availability, or update frequency of these sources.
11. POPIA Compliance
EchoGuard processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).
Facial data processed by EchoGuard is used solely for comparison purposes and is not sold or unlawfully shared. Users acknowledge their responsibility to ensure lawful processing and consent where required.
12. App Store & Platform Compliance
EchoGuard is intended for lawful security awareness and informational purposes only.
Users must comply with all applicable terms, policies, and rules of app distribution platforms, including Google Play and the Apple App Store.
13. Acceptance of Terms
By creating an account, downloading, accessing, or using EchoGuard, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.
14. Changes to Terms
Perceptix reserves the right to modify these Terms at any time. Continued use of EchoGuard after changes are made constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.
